Executive actions, so far, are a blow hole. The grotesque is not king, not the the big guy. The President has powers. He’s not all powerful. The branches of government are structured as such, for a reason. We are a democratic society. No dicks need apply…
In the very long term (as in after trump leaves office), yes. In the short term… no. Congress could try to pass a bill blocking Trump’s action but Trump would just veto it, and without a 2/3rds majority in both houses actually willing to show some spine, congress isn’t likely to overturn the veto. The more likely route is that congress would sue, kicking the matter to the courts, who would probably say “no, you can’t do that.” Trump would appeal and the whole thing would keep getting kicked up the totem pole until it ended up in the supreme court, who would probably say “no, you can’t do that and here’s why.” The way the executive orders are set up the president can do a lot with very little restriction from congress, although while he can use money already assigned he can’t actually apportion money towards an unintended purpose, as it is the role of congress to control the purse. Also any order he signs can be immediately rescinded by his successor. He COULD declare a national emergency to free up funds dedicated to dealing with fires, hurricanes, earthquakes, etc., which he already tried to do with the border wall. This would probably be a more viable use of that power and he could probably get away with it in the courts. In the long term though congress needs to more clearly define what a national emergency is and limit just how long an emergency lasts after a president declares one. We’ve technically been in a state of “emergency” with Iran since 1979, which frees up the president to act (in regards to Iran) in ways that would normally require approval from congress. If something goes on for over 40 years it may be a disaster but it probably isn’t an emergency (unless it’s like a meteor slowly headed for the planet or something).
