He will confront? I can’t imagine that he will testify and I think that he’d blow a gasket if he listened to closing arguments. I also can’t imagine what he could say to defend himself given the number of witnesses and his deposition testimony.

No he won’t. He was just hoping the judge would say, “No because he’s too late”, and then claim the judge wouldn’t let him testify and how unfair the judge was. Well guess what? Judge did no such thing but instead is giving him time to come in even when his lawyer insists that he will not be testifying.
