1. FED First Amendment Claim: Free Speech as Value Claim
2. FL Pro Warranto: Abused his power to suspend an elected official
15 week bank found not constitutional-
Hello Kathryn

DeSantis said that his authority to suspend a state officer comes from Article IV, Section 7 of Florida’s state constitution, which says that “the governor may suspend from office…any county officer, for malfeasance, misfeasance, neglect of duty, drunkenness, incompetence, permanent inability to perform official duties, or commission of a felony, and may fill the office by appointment for the period of suspension.”
-
@Romance with the Past So you have to answer these 2 are possible. A: Does using the power of discretion, a power that many govt employees use every single day, count as neglect/incompetence. B: Does proclaiming you will not follow a law the court has declared unconstitutional, count as neglect/incompetence.

-
And thank you for standing with women..there are many prosecutors in many states doing this same thing and standing with women are not being removed by their governors..
-
You df…. this attorney decriminalized mugging up to 900$
-
he’s not standing with the women who’re in the womb. Abortion isn’t about women, it’s about children.
-
@Maggie Norris woman use contraception if your gonna be promiscuous . Ain’t hard
-
HE NEEDS TO MOVE TO THOSE STATES THEN WERE HE’LL BE MORE AFFECTIVE ✌
-
Heather….that isn’t his job. He doesn’t get to pick what laws he will follow
-
-
This Anchor should not be asking him those questions knowing he has a court case going on. Sounds like he’s trying to make him lose his case

Stop seeing that: “I put my hand on the Bible”. So many do the same as you and lead others to hell. You read the Bible?

This is what happens when power goes to someone’s head.

@Barbara Ann It is his choice. But the governor has the right to suspend a DA refusing to do their job. Should a DA dictate the laws of the state.
-
@Barbara Ann What are you taking about. It’s his refusal to
-
@Barbara Ann Yes he did that’s why he was suspend. They need someone to do the job if he won’t.
-
-
And they say they are the party of freedom!
-
If your a da your job is to prosecute crimes. Not to let criminals walk. WTH does firing a chit da have to do with freedom?
-
@Fletcher Reed What?
-
This man is supposed to uphold the laws on Florida’s books. What exactly does that have to do with freedom? He failed. He is gone.

under the Florida Constitution, art. IV, sec. 7:
(a) By executive order stating the grounds …, the governor may suspend from office any state officer not subject to impeachment, … or any county officer, for malfeasance, misfeasance, neglect of duty, drunkenness, incompetence, permanent inability to perform official duties, or commission of a felony, and may fill the office by appointment for the period of suspension. The suspended officer may at any time before removal be reinstated by the governor.
(b) The senate may, in proceedings prescribed by law, remove from office or reinstate the suspended official and for such purpose the senate may be convened in special session by its president or by a majority of its membership….

I’m pro-choice and I’m pretty sure he shouldn’t be fired for what he did but it is an interesting question, to be fair. I’m thinking of that woman, a few years back, who wouldn’t certify gay marriages or something like that. She wasn’t doing her job. I think there does come a point where elected or not, you’re not doing your job and its not up to the prosecutor or the police officer to decide what the laws are. Cause then suddenly white people don’t get charged and black people do. Or women don’t get charged and men do. We all know both of that already happens and prosecutorial discretion is part of the reason why
-
@X Gempler I will answer your question when you answer this question first.

@Fido Barks Exactly.

If he is elected to that position. Can the governor just suspend him? Wouldn’t it require a recall?

@Scratch King Show me and I will listen as long as the laws you are referring to aren’t the laws deemed unconstitutional..

@Scratch King think of it this way. if a person said they weren’t going to come to work next week when they were scheduled to be there, you don’t get to fire them this week for not showing up. 🤷♀ what was the harm in waiting for the guy to not do his job?

You pledge an oath of office and you pledge not to look into abortion cases. Would a reasonable person assume from that pledge you agreed to that you would not seek abortion related cases?
-
You enforce the laws on the books or you have the right to resign due to moral objections in this country. You have no right to remain in that type of position and only enforce the laws you personally agree with.
-
Florida State Attorney Andrew Warren said he’ll review abortion cases on a case-by-case basis to weigh the fact that if any laws were broken, he’ll act accordingly. I hope you’ll never sit on a jury with your warped thinking.
