Okay, there is a lot of purposeful and willful misinformation about Presidents using the Insurrection Act in the past. A President CAN only use the Insurrection Act to send military troops (the National Guard) into a State to enforce (Federal Law) as Kennedy did at the University of Alabama in 1963. But Law Enforcement (Laws Mandated and Passed by State Legislatures) can only be enforced by the States. That means A Governer and State Legislature MUST request Federal Assistance for a President to use Military troops in a state to enforce state laws like Law Enforcement, otherwise, it’s unconstitutional. The only exception is Washington D.C., it is not a state, it’s a Federal District.
10 U.S.C. §§ 331-335
Sec. 331. Federal aid for State governments
Whenever there is an insurrections in any State against its government, the President
may, [upon the request of its legislature or of its governor] if the legislature cannot be
convened, call into Federal service such of the militia of the other States, in the number
requested by that State, and use such of the armed forces, as he considers necessary to
suppress the insurrection.
Sec. 332. Use of militia and armed forces to enforce Federal authority
Whenever the President considers that unlawful obstructions, combinations, or
assemblages, or rebellion against the authority of the United States, make it impracticable
to enforce the laws of the United States in any State by the ordinary course of judicial
proceedings, he may call into Federal service such of the militia of any State, and use
such of the armed forces, as he considers necessary to enforce those laws or to suppress
the rebellion.
For what it’s worth, Wikipedia [“Insurrection Act”] reports that the Act has been invoked by: Thomas Jefferson, Andrew Jackson (twice), Ulysses S. Grant (three times, twice without a request by a State and not in DC), Rutherford Hayes, Grover Cleveland, Woodrow Wilson, Franklin Roosevelt, Dwight Eisenhower, John F. Kennedy (three times, each time without a request by a State, and not in DC), Lyndon Johnson (four times), and George W.H. Bush (twice). Of course it’s possible to make a credible claim that many of these instances were illegal.
