NYT: Trump plotted to pick loyalist as acting AG to overturn election

Justice Department lawyer Jeffrey Clark nearly convinced then-President Donald Trump to remove then-acting Attorney General Jeffrey Rosen and use the Department of Justice to undo Georgia's election results, The New York Times reported on January 22. CNN's Jessica Schneider reports.

    3. @Glen Forde Incitement is not a crime under the 1st Amendment unless it meets certain criteria. It has to be intended to cause violence. If I go downtown and I say to someone standing in front of a bank “let’s rob this bank right now”, I haven’t really incited anybody because it’s not very likely they’ll help me rob the bank. My proposal has to be “likely” to cause imminent violent action.

      If I say let’s meet here tomorrow and rip things up, I’m not inciting because – in the words of the Supreme Court – where there is time for better counsels to prevail, the remedy for speech is more speech.

      Bottom line did tRump cross the line?

      It’s quite rare that somebody can be convicted of incitement. In applying that to the president’s speech on Jan 6th, it’s an agonizingly close case. It’s pretty goddamn imminent because he’s telling people to march to the Capitol and I will march with you. There wouldn’t be any time for better counsels to prevail because you’re just going to leave the Ellipse and walk down Pennsylvania Avenue. He says “we have to fight and show strength”, but he also said we’re very “peacefully and patriotically” going to go to the Capitol, right there he’s covering himself.

      He clearly knew there were people in that crowd who were ready to and intended to be violent, and he certainly did nothing to discourage that. He not only did nothing to discourage it, he strongly hinted it should happen.

    1. @Roland Lytle I really think they would .. the main issue with the republican party is that this is their nature for a long time – ever since Obama became president, something triggered in their minds and they decided to go rouge. It was seen by McConnell’s actions when he said his only job was to block everything Obama wanted to pass .. even if he had previously agreed with it. Obama’s election also triggered the growth of hate groups around the country – Trump came in at the right time and played on these hates. Democrats have issues – but theirs have never really been legal (i.e. disobedience of the law) or racial issues .. as such there’s a much less probability of a racist democrat taking over the office (not impossible – but much lower percentage as to be negligible).
