    3. @LionOfWar Where does it say anything about “divided government” in the Constitution? It tells the president and the Senate what to do. There is not a single mention of political parties in the Constitution, is there? Republicans who claim to adore the Constitution simply don’t. They recognized in 1994, after 60 years of Democratic dominance in the Congress that they couldn’t win on issues. They have just as much polling as anyone else and know they still can’t win on issues. They have the results of 2018 as the latest evidence to back that up. So they ignore the basic law of the land as it suits them because that’s the only way to keep power.

  1. I just hope the new Associate Justice abides by and upholds the Constitution. It’s not about towing the party lines. It’s about upholding the laws of the land.

    1. @Jock Young because the president and the Senate were not the same party so it is different. Everytime a chair on the supreme court was empty in a election year the president at the time has tried to fill it.usually it goes through if the president and Senate are same party and usually it doesn’t if they are from different parties. The supreme court has been liberal for 50 years and Democrats are freaked out only because it starting to become more conservative. The president is following the constitution and gets threatened with impeachment. There is something wrong about that. If the shoe was on the other foot the Republicans would be unhappy but they wouldn’t threaten impeachment over it.

    1. @Tim Kozlowski The vacancy occurred in February, 2016, 11 months before the end of Obama’s presidency. Count the months since then. Did McConnell not even threaten to block Democratic nominations for four years if Hillary had won? How is that constitutional?

      The Senate plays an equal role.

      in 2014 the American people elected Republicans to share the SC appointment process with Obama. When an vacancy occurred in 2016, the Senate said no.

      In 2016 and again in 2018, the American people decided they wanted democrats no where near the SC appointment process so they gave the power solely to the Republicans.
