Whenever the Republicans gain power they abuse it, not just a little but they get very aggressive which leads to push back. We had a Voting Rights Act because of their abuses in the past; it expired recently and, no surprise, the Republicans are back at it again.
I strongly encourage you read Article III:
“Section 1.
The judicial power of the United States, shall be vested in one Supreme Court, and in such inferior courts as the Congress may from time to time ordain and establish. The judges, both of the supreme and inferior courts, shall hold their offices during good behaviour, ”
know what that means?
-Congress can establish any courts it deems necessary
-the JUDGES (meaning all Federal judges) as a GROUP shall hold THEIR offices (again, as a group), basically for life.
-as you know, judges are moved, constantly.
-there is NOTHING in Article III to prevent Congress from moving Judges. ANY judge.
My suggestion is the two parties agree on a judicial rotation schedule for the top courts, one that puts politics at a greater distance.
Why would the GOP agree? because even THEY know if the public overwhelmingly distrusts the judicial branch, then the gig is up.

@Shockwave 11 An interesting twist for you: scotus would have to recuse themselves, because this kind of change creates a monster conflict of interest. thing is, it’s rational. what neither the Right never gets is that your background ALWAYS shapes your judgement. Amy Barrett thinks it’s the most natural thing in the world for a document to enforce “minority rule”.

Exactly. Unless there is a law and someone willing to prosecute them for it, they will do as they please. Also, Bill Barr is not going to prosecute anyone on the right.
If the Democrats won’t pack the court, there WILL BE A SPLIT in the Democratic Party.
They need to expand the SCOTUS to 29, then split them into randomly chosen groups of 9 by case. This how some lower appeals courts work.

Term limits for everyone. Not having any for anyone in Congress or the Supreme Court has been a contributing factor in impeding this country from progressing further than it can and wants to with each generation that comes into adulthood, but governed by relics of a dying generation trying to force the world around them.
You miss the entire point of why the judicial branch doesn’t have term limits. It isn’t supposed to be able to be bought or influenced by outside pressures. They are supposed to rule on the side of the law not political bias.

I was down last evening with the Barrett confirmation; just quiet and sad. Then, I watched this segment on Morning Joe today and it gave me a glimmer of HOPE. I have been sharing this video in different fb groups as a way to uplift others who are as discouraged as I was last night.

Mitch McConnell said at the time of Merritt Garlands nomination that a Supreme Court nomination in the last year of a president’s term should be held until after the election for the people to decide. Lindsay Graham, Chairman of the Judiciary Committee said that he would not hold a vote on a Supreme Court nomination during the last year of Trump’s term and that people could use his words against him. Both pushed the current nominee for appointment before the election. They both also broke their oaths of impartiality taken before the impeachment trial, which they both openly declared they were not impartial before the trial, then swore on a bible before the Chief Justice of the Supreme Court an oath of impartiality before the trial. They are both men with no honor,whose oaths and promises mean nothing.

The Democrats started this under Bush, look up “The Biden Rule” where he made up that a new supreme court justice should not be nominated the summer of an election year. Back then, McConnell warned him and fellow Democrats they will reap what they sow when conservatives hold majority Senate. You want to thank someone for taking Senate ability to slow or prevent an incoming Justice, thank Mr. Vice President Joe Biden.
When McTurtle speaks he’s speaking straight to the republican donors it’s very easy to see. Remember him saying his top priority was making Obama a one term president? Bingo.
It’s both party’s constitutional right, HOWEVER Democrats needs to stay on message surrounding the outlier “precedent” Mitch McConnell set.
