There is a not withstanding clause in our Constitution.

The not withstanding clause merely allows the passage of legislation that would otherwise violate the Charter, it does not mean that the Charter applies to non-Canadians. The Canadian Charter can not be used by whomever wishes to rely upon its provisions regardless of their citizenship, nationality or domicile.
