@Maximiliane Musterfrau in regards to your anti digital comment. These documents are created on computers and then printed out. It’s not like they are hand written or typed out on an old school typewriter (which also leave a mark unless you’re destroying the rubber/leather typewriter pad or destroying the surface you wrote on (imprint thru the paper). Digital is actually unhackable if it’s never connected to an internet.
The thing I think most don’t understand about classification is, how and who determines a document is classified. There isn’t some magical agency determining classification and tracking it. Classification is ultimately determined by the author, next step would be the department, next another agency/department who has determined that information needs classification. If I am a government employee and I send you an email, and I label it confidential, guess what? It’s now classified. You share it, even as a civilian, guess what? You’ve broken the law. Only my supervisor chain can change the classification, and they are required by law to notify me the author of the change with a few exceptions. Say my document contains something another department/agency has determined is classified, they can essentially up the classification, but they can not alone declassify it. It’s a chain of custody process. If that other department decides to declassify the document I wrote, guess what? It’s still classified until either I or my supervisor chain determines it’s not (but again the law requires a notification and chance for the author to dispute declassification. It’s one of the reasons, the jfk files are taking so long to declassify, because some of the authors and some of the departments have not agreed to declassify. Despite congresses order to declassify those documents, the laws controlling and determining classification were not changed and therefore congresses order isn’t cans technically can’t be followed until either the agency involved or the author signs off on it. If the author is dead, it’s easier to declassify because so many more people have the ability to declassify a document.
I know it sounds simple to criticize the lack of tracking of classified, but when the very nature of a classified document being based on need to know only, others not involved technically don’t need to know. Keep in mind that literally millions of documents could be created each year bearing a classification. Prior to the presidential records act, many classified documents would just be shredded / destroyed. Now every document created in government is required to be stored by the national archives after a presidents term. The national archives doesn’t have access to the document, honestly doesn’t even know the document exists until someone has turned in their documents. Which I’m guessing that Trump cabinet members turned in documents that made reference to the classified documents Trump had. That’s why they knew Trump was retaining documents. If Trump had simply returned them when asked and or when discovered, this would be a non issue. Or should be a non issue.
When you personally pack something, that you know you shouldn’t, you wrong and guilty. But when others in the office pack items on your behalf, I don’t see the guilt or ill intentions.
Then on the other hand, you have a person stating they knew they took the item(s) and don’t want to give them back, now that’s a horse of a different color! That goes for Democrat, Republican, Independent or Liberals. President, Vice President, or Passed President…also, it doesn’t matter what Race you are!

When I was a teen, I checked out some movies at my library. They said they were due back ‘in one week’. It was a Wednesday, so I figured I needed to bring them back the following Wednesday. Nope. ‘Tuesday’, they said when I went to turn them in. Since the first day counted, I guess. I explained the confusion, but they wouldn’t budge. They told me I couldn’t check out anything else unless I paid a ten dollar late fee. That was about 18 years ago and I haven’t set foot in a library since.

@shelley king Actually, NARA was notified, by someone who works at Maralago, that Trump had been showing, what appeared to be classified information, to guests at his little club. That is what sent them scurrying to find out what was missing. Somehow I doubt either Biden or Pence had been so dismissive of national security.

That’s not how it works, or could work. Do you think NARA keeps track of all classified documents? It doesn’t. I receives documents, from POTUS and VPOTUS, when they leave office, and keep track of those. But, other classified documents, like those generated in the several branches of the military, DARPA, ONE, FBI, CIA, etc. etc. never go to the archives, but are retained (hopefully) in the issuing department.

Isn’t there a gov’t agency tracking the movements of classified docs? Who ruled them as classified to begin with? Is the same entity charged with tracking them? National Archives? National Security Agency? If the docs are out of place, and are missing — from what agency are they missing? WHO hasn’t been paying attention to what’s missing from their files? Why don’t they run a simple report and learn from it what’s missing? Let it be known to those who have them and tell them a gov agency rep will be there shortly to retrieve them. Why is this such a mystery?

And every governmental agency, office, department, installation which has authority to classify materials it creates also has means and methods and protocol to use and store those materials safely as well as destroy documents and records which have outlived the need for which they were created.
It’s nuts for people to think that the US ambassador in Zambia has to send the very documents he needs on a daily basis to run that embassy back to the US Archive every evening and then check them all out the next morning. He handles classified material all the time and it is kept securely in the embassy as is true for all ambassadors and US embassies around the world and every US military installation and every government contractor.
Seems necessary to say this again for those who don’t understand: an archive is a repository for materials of historical significance. It is not a library.

They are kept according to security protocols and procedures where they are needed on a daily basis.

When my company did business with the federal government, we had a separate safe in a separate area of the office for papers related to government business and the entry into the space where that safe was cemented into the floor required two different keys assigned to two different people to open the door. The combination on the safe was changed regularly and the combo changer never had one of the keys to the door. Even as civilians we were terrified that we might screw up and end up in a federal pokey.

It’s not just the matter of someone possessing classified documents (which is problematic in itself) it’s about how they came into possession of them and what they did when they discovered they had them. If someone took them intentionally and/or refused to return them when asked, that someone IS THE REAL PROBLEM.

I’m a retired librarian and library administrator who was in charge of university libraries for more than half of my 43 year career. During that time, I was asked several times by widows of distinguished professors to go through their files, before they were turned over to the university archives or another repository. The reason I was asked to perform this service was the not-inappropriately-feared likelihood that a survey of the gentlemen’s papers would turn up awkward, embarrassing or otherwise problematic things. Indeed, in each case, I came upon cashes of pornography from various eras; evidence, at least, that the subjects had lusty appetites for the pornstars, and commonplace fetishes of their era. Better that I uncovered this and disappeared it, than young technician Missy, at the archives, being presented with evidence for the emeritus professor’s appetite, say, for femdom or BDSM, or underage, God forbid, which I never encountered.
Everybody who has files has stuff they would like to hide or lose, plus, stuff they forgot about, or stuff they lost. What is needed here is a serious protocol and robust procedures, not just in the Executive branch, ideally, carried out by someone other than the subject’s personal staff. Also, deadlines for handing over various classifications would be good. It might help bring a bit or order out of the chaos of a typical transition.
In the US State of North Dakota all attorney general’s emails, edocs and anything on a ND State computer were destroyed, on occasion of his death last year

I’m sure, and it is shocking because it shouldn’t even be able to happen, but I’m sure that it’s becoming very evident this is an all too common for this to happen. Every document generated must be thoroughly tracked from inception until they are where they belong at the end of every administration. Each person must be registered as having it and not removed from the “list” until said document is returned to where it belongs. If they have to be kept in the skiff or whatever it is called and only viewed there, never to leave (which is what I thought the procedure was to begin with), it has to be completely enforced. Sorry to the President’s, Vice President’s etc you will no longer be accommodated for your precious time and leisure, that benefit has to end!

The National Archives should be ultimately responsible for not keeping track of where classified documents are at all times. Much stricter records need to be kept concerning who has each specific document and when they are to be returned. Every public library does a much better job of this!

I doubt the archives ever received these documents, to be logged in. Many different agencies create classified documents, and some don’t keep track of them.
I’ve been saying this since DAY ONE! Every former POTUS and VP should have their offices, libraries, homes checked for classified or govt documents. AND any of those congressmen who sat on the Intelligence Committee.

I remember co-workers getting instantly fired for security violations. It was things like not locking a safe or leaving a document on a copier. But taking documents home? I never saw anything on that level. We would have been prosecuted and sent to jail. There’s a completely different standard for rich and famous politicians.

Why do folks like you not get this yet? There are different levels of classification. Unless it’s confirmed they are all top secret documents, then it’s very believable that they can accidentally take documents marked classified back to their home office.
I keep having to explain this scenario all the time. If you have several thousands of documents in your White House office with tens or hundreds of classified material , and then on your last day of work, you get to pack a couple of boxes home, there’s a high chance you can accidentally pack a few classified docs back home.
So unless there’s a a specific protocol used to check every document leaving the White House, then this will always be a normal behavior of human beings.
Trump on the other hand sounds guilty because he failed to return the missing documents that were asked for.
Also people like you will go to jail, because you are handling one or two classified documents in your office(no excuse for you to take them home as an accident) . President and Vice President deal with thousands in their office(they have excuse that they accidentally took 50 documents home) when someone else moves their belongings home.

I did a Google search on which agencies are responsible for securing classified documents, and there were several. But the National Archives was NOT one of them. Which raised my eyebrows.
I’m totally surprised at the frequency, and amount, of the classified documents that are not where they should be. When I dealt with classified documents (many moons ago) we were required to sign them out (if we were allowed to) and sign them back in when we were done with them. The “caretakers” of the documents (FBI, etc) took great care to know where all of their documents were at any point in time.

I was concerned if I had any in my house so I did a search. I was surprised to find some Classified Ads that I HAD NO IDEA were there. Now I see how they could have forgotten these documents in their homes. I wonder how many Jim Jordan has in his. Maybe they need to hire a librarian at the National Archives, though at this point one has to wonder how many are left in the Archive.
As I said as long as the politician is willing to cooperate with the Gov after documents where found to be missing Nothing should be done to the politician. But if the politician forces the FBI to raid your building, because you refuse to return documents they know you have and lie about it, you should be prosecuted.
