When writing the Constitution, the Founders realized that, where the President is concerned, there might well be special circumstances particular to the office of the President. That’s WHY they drafted the Impeachment rules. And it’s why they used the term “High Crimes and Misdemeanors’, rather than simply ‘Crimes’. And they gave Congress wide latitude for what entailed impeachable offenses.
Rather than simply recognizing actual crimes, they gave Congress the latitude to include conduct that is clearly wrong, even if not criminal. Impeachment is really more like the military term “conduct unbecoming …”.
This is actually what Mueller was getting at as well, in his final report for the Special Counsel’s investigations. Impeachment could be termed as committing ‘conduct unbecoming the office of the Presidency of the United States.’
The Special Counsel’s final report lists multiple instances, in BOTH sections, where President Trump’s conduct was ‘conduct unbecoming the office of the Presidency.’
