Regarding the Jones phone records and other materials accidentally turned over to the Sandy Hook parents’ attorney, you left out a very important fact that the judge cited when making her rulings on those materials. The defense attorney was informed immediately that the link to the digital documents was likely an error, but failed to follow the process set forth in Texas law to get those documents protected and deleted by the plaintiffs after the fact. The phone records are a small part of a much larger trove of documents related to the case. The judge also indicated correctly that most of the documents turned over would NOT be subject to privilege and should have been turned over more than a year prior. The very records the Jan. 6 committee is likely interested in would almost certainly not be covered by attorney-client privilege, and even if they were, the privilege, under Texas law, is waived when they are turned over as discovery if the defense does not follow the procedure for reclaiming the privilege and protected them. This is disbarment-level incompetence, and Jones is royally screwed now. My understanding is that Roger Stone, Tucker Carlson and the other usual suspects are pretty nervous about what’s in those texts.
