It is an Emergency when: (a) the municipal and provincial governments declare emergencies, (b) those police departments continue to be overwhelmed and can no longer maintain law and order. (c) At this point, it becomes a national emergency.

What part of the convoy and protest in Ottawa are illegal other than the PM saying they are? Not a Canadian, so am not sure what the laws are. It seems like he just kind of said “I declare it illegal, so now it is illegal.”
